Charlottetown guide: compare residence obligations without spending the household reserve on paper

USAvisa field guide · 4 minute readReviewed 7 September 2026
THE SHORT ANSWER

A residence comparison should distinguish qualifying investment or gift obligations from money retained for household needs. A total family balance does not establish either EB-5 eligibility or the official Gold Card outcome. An EB-5 and Gold Card comparison must begin by refusing to treat all large payments alike. EB-5 requires qualifying capital at commercial risk and the required job creation, followed by conditional residence if the immigrant process succeeds. Gold Card is not a conventional visa; its stated framework involves a nonrefundable gift by an individual applicant or corporate sponsor to the U.S. government under official instructions, plus vetting and applicable immigrant-category conditions. Hypothetical example: the owner of a specialty-lens laboratory has funds for an EB-5 project and receives a private proposal describing a Gold Card payment. Decide which legal framework and which official recipient apply before moving money.

01

Identify the actual EB-5 capital

Hypothetical example: the investor allocates some funds to a project and keeps the remainder for living costs and later arrivals. Trace the lawful source and path of the actual capital, separate fees and confirm the current applicable threshold. Review capital at risk and qualifying jobs under the relevant structure and method, generally ten jobs. Reserves outside the investment are not automatically qualifying capital. For EB-5, trace source and path of funds, identify the new commercial enterprise, check the relevant capital threshold, and understand the project’s job methodology. Retained household reserves, fees, and tax liabilities must not be counted as investment capital. The reader must decide whether the money is documented and genuinely exposed to gain or loss, rather than merely available on a statement.

02

Verify Gold Card family and payer terms

The official gift framework is tied to EB-1 or EB-2 availability and applicable requirements, vetting and admissibility. Confirm current individual or corporate obligations and intended family inclusion. Do not copy dependent terms from another category or describe the gift as recoverable EB-5 capital promising repayment. For Gold Card, verify current government instructions, exact payer, recipient, amount, family terms, and the underlying eligibility basis. Do not recast the gift payment as a loan, commercial investment, recoverable deposit, or substitute for immigrant eligibility. A corporate offer and an individual applicant may raise different questions. The decision is whether the payment pathway is confirmed by primary official materials.

03

Compare the household’s remaining uncertainties

Review actual relationships, ages, visa availability and present status alongside financial obligations. A shared budget does not establish the same outcome for every person. Neither payment capacity nor sufficient living reserves guarantees approval or timing, and a pending proposal does not authorize an early move or employment. Timing and family matters remain independent of the headline amount. EB-5 conditional residence has a later removal-of-conditions stage; Gold Card payment or pending review does not authorize immediate activity. Review each family member’s relationship, age, documents, visa availability, and present status. The best choice may be to keep current work arrangements until the applicable process produces a status that supports the planned move.

04

Distinguish capital, official gifts and residence stages

EB-5’s September 7, 2026 capital minimums are US$1,050,000 or a qualifying US$800,000 for targeted employment area or infrastructure projects, with statutory adjustments starting January 1, 2027. The petition is not residence; the applicable residence process and later removal of conditions remain, including the usual I-829 window in the 90 days before the second conditional-residence anniversary. Gold Card instead describes a nonrefundable US$15,000 fee per person and, after successful vetting and instructions, a government gift of US$1,000,000 individually or US$2,000,000 corporately. Each eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1,000,000. Confirm current corporate maintenance and transfer conditions separately. Neither framework guarantees eligibility, admissibility, visa availability or timing. EB-5 also requires investor engagement in management or policy formulation and at least ten full-time jobs for qualifying U.S. workers; a spouse and unmarried children under 21 may derive two-year conditional residence, with Form I-829 filed in the 90 days before the second anniversary. Gold Card is not a conventional standalone category: its U.S.-government gift and processing fee are not an EB-5 investment, and every current term must be re-verified before money moves. Document retention should reflect the route actually selected. EB-5 calls for a continuing evidence trail on capital and job creation through the conditional-residence stage, while the Gold Card analysis depends on current official gift-payment instructions and the applicable immigrant requirements. The reader must decide which records prove the chosen path without blending separate financial obligations into one balance-sheet narrative.
