Charlottetown TN guide: compare the job offer with the household’s real needs

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A TN assessment should establish the actual professional offer while leaving family permission as a separate question. A commercially attractive job does not automatically authorize every household member’s intended activity. The document decision is not simply how many pages to collect; it is whether the evidence makes one coherent professional story. Start with citizenship, the exact profession, the real employer, duties, qualifications, and the intended dates. Canadian nationals may request TN classification at an inspection location, and an employer can use Form I-129 through USCIS where appropriate. TN is not permission to run the applicant’s own U.S. business as self-employment. Hypothetical example: a public-health statistician receives a research-hospital offer while also considering a minority investment in a diagnostics start-up. Choose which arrangement is being presented, then keep the offer evidence separate from the investment documents.

01

Define the employment proposal accurately

Hypothetical example: the applicant compares a professional offer with buying a business. Identify employer, duties, ownership and control for each, without blending their facts. TN requires eligible Canadian or Mexican citizenship and work in a listed profession with the required qualifications. Canadian permanent residence does not replace citizenship eligibility. For the employment package, ask the employer to supply a signed explanation of the actual work, reporting relationship, worksite, compensation, period of need, and the profession being relied on. Match each required credential to a primary record, and resolve licence or translation issues before the proposed date. The reader must decide whether the job description needs revision because it describes a different occupation from the one claimed.

02

Match credentials to the actual profession

Identify precise qualification requirements, including permitted alternatives, and link them to genuine records. Business experience or available purchase funds does not universally replace a prescribed credential. Disclose relevant ownership interests: foreign ownership alone is not a blanket disqualification, while TN is not general authorization for U.S. self-employment. Use a record index that says what every item proves. Keep passports, degrees, transcripts, experience letters, credential analysis if needed, and employer records in dated order. Do not use savings statements or a future business idea as a substitute for the professional evidence. A missing date, signer, or duty explanation is easier to correct before the application or inspection process than afterward.

03

Identify the household consequence before choosing

TD does not authorize spouse employment, including remote work while physically in the United States. Review that need separately from the principal’s salary and duties. Use the actual selected offer for the appropriate process and do not assume a business purchase, pending application or desired start date authorizes present work. A Canadian citizen may request TN classification at a port of entry, or a U.S. employer may file Form I-129; a Canadian generally does not need a TN visa stamp. U.S. self-employment is prohibited, ownership stakes must be disclosed, and TD dependants may study but may not work. Household documents answer a separate question. TD family members may accompany or follow but cannot take employment, including paid remote activity performed while physically in the United States. Decide whether each family member’s proposed activity fits the actual permission before signing a lease, accepting a second job, or scheduling school around an unconfirmed date.
