Let’s make your move.
✦WORK.
BUILD.
BELONG.

Questions reaching this desk from Stratford usually arrive with a category already attached, normally the one that worked for somebody else. A category is a conclusion, though, and not a starting point. Six routes are set out on this site, and each interrogates a narrow part of a situation: one looks almost entirely at a credential and a description of duties, a second at a corporate ownership chain and a year of employment history, a third at where money originated and whether it can still be pulled back. Assemble the raw facts before choosing which slice matters, because that sorting is most of the analysis.

THERE’S MORE THAN ONE WAY FORWARD.

THE DREAM IS YOURS.
LET’S FIND THE WAY.

A shellfish biologist employed by an aquaculture operation, an innkeeper hoping to buy a comparable property on an American coast, and an accountant whose spouse has already been offered work across the border are asking three unrelated legal questions that happen to share a destination. Reading the six route pages against one another shows which facts each category examines closely and which it disregards completely. A first conversation with an adviser then becomes far more productive, because it can turn on one missing letter, licence or bank record instead of on which acronym somebody described as quickest.

For a Canadian citizen the listed profession and the described duties carry the entire application, and both have to be right before anyone travels.

Selections stay in this page session; no personal documents are collected here.

YOU WEREN’T
MADE TO
THINK SMALL.

Two situations recur here. The first belongs to people whose employer, laboratory or processing plant already has an American customer, affiliate or parent company, so their question is settled by citizenship, a credential and three years of actual duties. The second belongs to people who already own something in this area, whether leases, a vessel, a small hotel or a professional practice, and who are weighing whether to own something comparable in the United States. That question turns on capital, control and a traceable history of funds, and almost nothing gathered for the first question helps answer it.

Personal support.
A practical plan.
No promises we can’t keep.

01

Write the situation down before naming it

Record the citizenship printed in every traveller's passport, three years of employment described by activity rather than by title, the shareholding of any company on either side of the border, and where investable money came from. Resist labelling any of it. Set out plainly, the facts group themselves.

02

Ask what each category would interrogate

TN examines citizenship, a listed profession and its own credential rule. L-1 examines a corporate relationship and a qualifying year of employment abroad. E-2 examines ownership, control and capital genuinely at risk. EB-5 examines a fixed amount, ten jobs and a lawful source. Underline every point your notes cannot yet establish.

03

Attach a document to every assertion

Diplomas and transcripts, a professional registration, a letter stating dates and reporting lines, a share ledger, a signed agreement, statements tracing funds from where they arose to where they landed. An assertion with no paper behind it is work to do this month, not something to explain to an officer later.

04

Bring the gaps forward, not the whole biography

A remote discussion of three unresolved points achieves more than a tour of the categories. It ought to end as a short list of actions: a letter to request, a record to reconcile, a corporate step that has to happen before any filing, and whether another member of the household changes the sequence.

A LITTLE CLARITY GOES A LONG WAY.

YOUR FUTURE.
NOW BOARDING.

The route pages can be read in any order. Each one is built on its own hypothetical situation, among them a biologist whose American job description drifts away from biology, a hotel general manager whose reporting lines look thin on paper, and a buyer whose purchase depends on water leases nobody has confirmed can transfer. Watching the same federal rules applied to different facts is the fastest way to locate the situation nearest your own, and the place where yours diverges is precisely what deserves an adviser's attention.

BEFORE THE BIG MOVE

LET’S CLEAR
A FEW THINGS UP.

Our processing plant ships most of its product to one American buyer. Does that relationship make me transferable?

A customer relationship is not a corporate relationship. An L petition requires that the two entities be parent, branch, subsidiary or affiliate of one another, provable from ownership records, with both actively doing business, and it requires one continuous year of your own qualifying employment abroad inside the previous three years. Supplying an American company for a decade, however exclusively, establishes none of that.

I have run a marine operation for eighteen years without finishing a degree. Does that open a TN?

TN reaches only the occupations listed in USMCA Appendix 2, and each listed occupation carries its own rule about degrees, licences or stated experience. Long operational experience does not substitute for a listed profession, although a few entries, including Scientific Technician or Technologist and Hotel Manager, are reached by routes other than a baccalaureate. Where no entry fits, ownership routes such as E-2 are usually examined instead.

If I sold my shellfish leases to raise capital, would the proceeds be acceptable money?

Lawful source and lawful path of funds is central to EB-5 and is scrutinised for E-2 as well. Proceeds from selling a lawfully held asset can be excellent capital, but the licence or lease documentation, the valuation, the sale agreement, any loan cleared on closing and the movement of the money between accounts all have to be shown. What defeats these cases is usually an undocumented step, not the nature of the asset.

Is it possible to meet someone in Stratford to discuss this?

No. There is no office in this town or nearby and no in-person appointment for this area, so all consultations happen remotely. Shneur Herman, Jo Kubti and Alexander Paton answer enquiries, and a licensed U.S. immigration attorney is engaged wherever a formal filing is involved.
