Charlottetown guide: record each household member’s actual citizenship

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A household’s Canadian residence does not establish identical U.S. route eligibility for everyone. Record each person’s citizenship and intended activity before comparing employment, transfer, investment or residence proposals. Canadian permanent residence is an important personal fact, but it is not a single U.S. immigration category. Start a comparison by recording the principal’s citizenship, every accompanying person’s citizenship, the chosen activity, and the organization or enterprise involved. That prevents a familiar Canadian residence document from being treated as proof of TN nationality or treaty-investor eligibility. Hypothetical example: a fisheries biologist with Canadian permanent residence is offered a position by a U.S. conservation organization while their spouse is a Mexican citizen. Decide eligibility person by person before assuming the household uses one route.

01

Separate residence from the principal’s eligibility

Hypothetical example: a Canadian permanent resident receives a professional offer while another family member holds a different citizenship. TN requires eligible Canadian or Mexican citizenship as well as listed professional work and qualifications. Neither a shared Canadian address nor a family member’s citizenship should be treated as proof that the applicant meets that requirement. For a professional-employment option, test citizenship, listed profession, actual duties, and qualifications. For an intracompany move, examine qualifying entities, the foreign employment period, and the genuine U.S. role. For an investment proposal, identify treaty nationality, ownership, control, committed risk capital, and the real nonmarginal business. The concrete decision is which fact pattern exists, not which category has the most attractive name.

02

Assess alternative proposals on their own facts

A genuine L transfer needs qualifying organizations, foreign employment and the actual managerial, executive or specialized-knowledge U.S. role. E-2 needs qualifying treaty nationality, committed capital and the enterprise the applicant will develop and direct. Do not treat these as automatic substitutes for every Canadian permanent resident. Collect records in separate folders by person and by route. A PR card, passport, civil records, employer letter, entity documents, and financial trail answer different questions. Where a family has mixed citizenships, mark which evidence applies to whom. A shared address or common bank account cannot supply an applicant’s missing nationality, employment history, or investment ownership.

03

Build the individual process into the household plan

Record relationships, ages and intended work or study for accompanying people. Confirm the actual process appropriate to the selected proposal before relying on a common travel schedule. One person’s possible eligibility does not authorize another person’s employment, and present activities must fit actual current permission. Canadian permanent residence and citizenship are separate facts, and a PR card does not confer TN eligibility. TD dependants cannot work, children may age out at 21, and each family member’s own activity determines the route. Build a staged household plan only after the principal route is chosen. Identify each person’s expected work, study, arrival, and contingency if the selected process changes. The decision may be to postpone an employment start, use an independently available route, or keep a second household arrangement temporarily. Present activity must fit actual permission, not a hoped-for combined move.
