IN THIS GUIDE · A hotel general manager whose organizational chart is mostly housekeeping and front desk
Start with the L-1A eligibility and application overview
Supervising a crew and managing an organization are different findings
Managerial capacity in the L context is not simply being in charge of people. Where an employee primarily supervises staff who are neither professional nor themselves supervisory, the statute treats that person as a first-line supervisor rather than a manager, unless the employees supervised are professionals. Bertrand's daily crew does not carry him over that line. There is a second and better path in his case: managing an essential function of the organization rather than personnel. If he owns revenue management, distribution contracts and the group's standards across both properties, functions the business genuinely depends upon, that is the case to build, and the petition should be drafted around the function rather than around a headcount.
The qualifying year belongs to the person, not to the property
Whatever capacity is claimed, Bertrand must have been employed abroad for one continuous year in the three years immediately before the petition, and that year must itself have been managerial, executive or specialized-knowledge employment with a qualifying organization. A year running the Stratford inn for the group counts; a year during which he was engaged as an independent contractor billing the group does not, and a year spent partly on a leave of absence can interrupt continuity. This is the requirement most often assumed rather than checked, and it is checked against payroll records, employment agreements and the dates on which duties changed.
Both entities have to be real, and the relationship has to be shown on paper
The Canadian and American companies must stand as parent, branch, subsidiary or affiliate to one another, and both must be doing business, meaning the regular and systematic provision of goods or services rather than the mere existence of a registration and a bank account. Because the group has bought a trading property rather than opening an empty one, that second element should be easy to evidence from bookings, payroll and supplier accounts. Where a group buys through a newly formed holding company, the ownership chain from the Canadian entity to the acquired operation has to be traced in share registers and resolutions, not asserted in a covering letter.
What a two-season plan looks like against a seven-year ceiling
L-1A status is available for a maximum of seven years, and where the American entity has been doing business for less than one year the first approval is limited to one year with evidence of secured premises and the capacity to support the role. Bertrand's two seasons sit comfortably inside the ceiling, but the group should decide now whether it intends this to become permanent, because L-1A confers no permanent residence by itself and the ceiling is not extended by good performance. A spouse admitted in L-2 is employment-authorized incident to that status, which often matters more to a household's decision than the length of the assignment.
