IN THIS GUIDE · Taking apart the claim that this is simply a quicker version of the investor route
Start with the GOLD CARD eligibility and application overview
The payment runs toward the government, and it does not come back
The official material describes a nonrefundable US$15,000 processing fee per person, and then, after successful vetting, a gift made by the applicant to the U.S. government: US$1 million where an individual applies, or US$2 million where a corporate sponsor pays for an employee. It is worth stating the direction plainly, because it is regularly reversed in conversation. Nothing is given to the applicant. The money is not placed in an enterprise, earns nothing, is not held on her behalf and is not returned if her circumstances change. Anyone describing it as capital, as an investment or as something recoverable is describing a product the official material does not offer.
Three steps in a fixed order, and money moves before certainty does
The processing fee comes first and is nonrefundable. Vetting follows. Only after successful vetting does the gift arise. That ordering is the single most important fact for someone weighing the route, because it means a payment is made while the outcome is genuinely unknown, and the payment is not contingent on the outcome. Marielle should therefore treat the first fee as an expense rather than as a deposit, and should decide whether she would still make it if the answer were no. Each accompanying spouse and each unmarried child under 21 adds a further processing fee and a further US$1 million gift, so a household multiplies both stages rather than sharing them.
It travels through categories that already exist and have their own rules
Successful applicants proceed under the existing EB-1 or EB-2 classifications, subject to the requirements of the category, to admissibility and to visa availability. That matters more than the headline. Those categories carry substantive requirements that a payment does not satisfy, admissibility is decided on its own separate grounds, and visa availability is published in the Visa Bulletin rather than promised by anyone. Before committing to the route, Marielle should obtain a candid assessment of whether she plausibly meets the underlying category on its own terms, because the framework does not create a new category and does not waive the one it uses.
Why the comparison she was offered does not survive contact with either program
The investor route asks for capital placed at risk in a commercial enterprise, requires at least ten qualifying jobs to be created, gives conditional residence for two years and then requires a further petition proving the capital stayed invested and the jobs exist. Every one of those features is absent here. A gift creates no jobs anyone must count, is not measured against a business plan, is not at risk in any enterprise because it is not in one, and cannot be recovered. The two are different instruments with different consequences and should never be presented as the same purchase at different prices. Terms must be re-verified on the official page before any money moves.
