Charlottetown E-2 guide: test the family staffing and funding assumptions

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A household acquisition plan should identify both who funds the business and who will perform its work. E-2 enterprise requirements and individual work permission need separate assessment before a family operating model is relied upon. An E-2 investment analysis should let the reader decide whether a real commercial commitment exists before funds are treated as a completed investment. Establish treaty nationality, ownership and control, lawful source, the path of funds, and the applicant’s role in developing and directing the enterprise. Money must be committed irrevocably and exposed to commercial risk, and the business may not be marginal. Hypothetical example: a maker of adaptive kitchen tools plans to buy a small U.S. workshop through escrow while retaining personal savings for the family’s first year. Decide which payments truly enter the business and which remain protected reserves.

01

Assign duties to actual people

Hypothetical example: the investor will direct the business, a spouse will handle customer service and a child is expected to help during holidays. Record each activity expressly. Do not treat ownership, an informal arrangement or family membership as employment authorization. The operating plan should not depend on unsupported assumptions about who can work. A first review should turn the transaction into a ledger. Mark purchase price, equipment, inventory, lease deposits, legal fees, insurance, working capital, and living funds separately. Then read the escrow agreement for the exact release condition and refund consequences. The concrete decision is whether the commitment is sufficiently real for this proposed business, rather than whether the household has a reassuring total balance.

02

Separate capital from household spending

Trace lawful source and path, actual commitment and purchase or escrow conditions. Personally secured or unsecured borrowing may qualify under applicable rules; enterprise-asset-secured debt does not count as the investor’s qualifying investment. Keep fees and living reserves separate from actual capital at risk. No universal fixed E-2 minimum applies. The enterprise record needs more than a forecast. Link the plan to premises, licences, suppliers, customer development, operating tasks, staffing, and a reasonable route beyond supporting only the investor. Do not let a spouse’s or child’s hoped-for help carry an unworkable business model; individual employment authority remains a separate question. The applicant’s control and day-to-day direction must be credible from the facts.

03

Assess enterprise and status together without merging them

Review qualifying treaty nationality, control, substantiality and a real nonmarginal enterprise. Qualifying E spouses may be employment-authorized incident to status with appropriate documentation; children do not receive work permission solely through dependent status. Closing or funding does not itself authorize activity. Review the actual transaction and individual records before the planned opening. Canada is an E-2 treaty country, but both investor and enterprise must have qualifying treaty nationality. Funds must be irrevocably committed and at risk, substantial relative to the business, and placed in a real operating non-marginal enterprise the investor develops and directs through ordinarily at least 50% ownership or operational control. E-2 provides no direct path to permanent residence. Choose the order of commercial steps with care. A signed conditioned purchase may support a plan, but opening a company or paying a seller does not by itself grant permission to work. Keep family arrival, outside employment, and school arrangements flexible. The reader must decide whether the transaction can wait for the proper process or needs a condition that protects both the buyer and seller.
