A transfer and a business purchase may both seem compatible with a household move, but their substantive requirements remain different. Compare the actual principal proposal and each family member’s activity before selecting a strategy. The practical choice between L-1 and E-2 is usually made by comparing two different factual stories, not by choosing the faster-sounding label. L-1 requires a qualifying organization relationship and prior qualifying foreign employment; E-2 requires treaty nationality, enterprise control, irrevocably committed capital at commercial risk, and a business that is not marginal. Hypothetical example: a manufacturer of ultraviolet water-testing devices can either transfer its foreign quality director to a related U.S. company or have the director buy an unrelated service business. Decide which plan is real before pooling corporate facts and personal funds.
Keep the transfer and purchase facts separate
Hypothetical example: a manager has a related-company assignment while the household considers acquiring an enterprise instead. Record employer, duties, ownership and capital for each option. Do not combine the transfer’s corporate relationship with the purchase’s funding as though they form one proposed arrangement. For the transfer route, identify the foreign employer, U.S. entity, corporate relationship, one-year foreign employment during the three-year lookback, and the actual managerial, executive, or specialized-knowledge duties. Time is limited: L-1A generally reaches seven years and L-1B generally reaches five. The decision is whether the U.S. role follows from the business structure rather than a desired relocation.
Assess the principal’s eligibility independently
L-1 needs qualifying organizations, relevant foreign employment and a managerial, executive or specialized-knowledge U.S. role. E-2 needs qualifying treaty nationality, substantial committed capital at risk and a real nonmarginal enterprise the applicant will develop and direct. Family preferences do not establish these requirements. L-1 requires one continuous qualifying year abroad in the prior three, a parent, branch, subsidiary or affiliate relationship with both entities active, and is capped at seven years for L-1A or five for L-1B; an unaffiliated-client placement cannot be labour-for-hire and remains under petitioner control. For E-2, Canada is a treaty country, funds must be irrevocably committed and substantial relative to the business, and the category has no direct path to permanent residence. For the investor route, trace the money from lawful source through transfer and commitment, then test ownership, control, business substance, and the applicant’s direction. There is no single E-2 dollar minimum. The reader must decide how much capital is genuinely subject to loss and whether the enterprise can grow beyond a minimal household living, without counting personal reserves as investment.
Compare actual dependent implications
Identify the relationship, citizenship and intended work or study of each person. Qualifying E and L spouses may be employment-authorized incident to status with appropriate documentation; an employment authorization document is not universally required for them. Children do not gain work permission solely through dependent status. Use individual records and confirmed stages when planning arrivals rather than assuming one household outcome. Compare family consequences only after both principal cases are accurate. Qualifying L and E spouses may work when valid classification and appropriate evidence establish permission; children do not obtain permission to work simply through dependent classification. A family should choose the route whose evidence and timing actually fit, rather than treating dependent work hopes as a substitute for the principal requirements.
