THE DIRECT ANSWER

No. Government processing, approval and visa availability remain separate from available funds.

Plan from actual stages

Identify the permission required for each person’s activities. Financial capacity does not authorize an early move or employment.

Hypothetical example: an investor funding a solar-component enterprise while a key construction permit remains under review. Separate the petition date from visa availability, consular or adjustment processing, admission, and the later conditional-residence period. The timing plan should also show when capital is invested or actively being invested, when jobs are expected, and which records will be retained for the removal-of-conditions filing. Do not describe petition approval as residence. A delay in construction can matter to the job evidence, so the decision is whether the project schedule still supports the documented employment assumptions before the investor commits.

EB-5 requires qualifying capital placed at risk, the required job creation, and the later conditional-residence framework. Petition approval alone is not permanent residence. The record must separately establish a lawful source and traceable path for the capital, because a promising project description cannot cure missing source evidence.

Use records created closest to the event: signed agreements, payroll or bank evidence, corporate records, licences, civil documents, and dated correspondence. A careful review identifies what each record proves and what it does not prove. Do not solve a factual gap by copying a favourable label from another route. Make the next decision only after the missing fact is either documented, changed, or plainly described as unresolved.
