Must every qualifying L spouse obtain an employment authorization document before working for a Charlottetown applicant?

THE DIRECT ANSWER

An employment authorization document is not universally required for qualifying L spouses, who may be employment-authorized incident to status with appropriate documentation.

Check the actual status evidence

The principal’s planned transfer does not itself establish the spouse’s current permission. Children do not gain work authorization solely through L dependent status.

Hypothetical example: a marine-inspection group transferring an executive whose spouse hopes to accept a separate hospital administration role. Identify the qualifying relationship for dependent status and then assess the spouse’s intended work through the actual L-2 rules and evidence. A qualifying L-2 spouse may work when valid classification and appropriate evidence establish permission, while children may study but do not receive work authorization merely as dependants. Preserve marriage and birth records, prior immigration documents, and a realistic staggered-arrival plan. The household should decide whether the spouse’s prospective employer needs a particular form of evidence before making a start-date commitment.

L-1A depends on a qualifying connection between the foreign and U.S. organizations and on a genuine managerial or executive position. The person must have worked for the qualifying organization outside the United States for one continuous year during the prior three-year lookback. Time in L-1A normally cannot exceed seven years; the separate L-1B maximum is five years.

Use records created closest to the event: signed agreements, payroll or bank evidence, corporate records, licences, civil documents, and dated correspondence. A careful review identifies what each record proves and what it does not prove. Do not solve a factual gap by copying a favourable label from another route. Make the next decision only after the missing fact is either documented, changed, or plainly described as unresolved.
