STRATFORD · EB-5 FIELD GUIDE

How should a Stratford investor sequence a business sale against the EB-5 timetable?

THE DIRECT ANSWER

Complete enough of the sale to hold the capital before filing, because the petition depends on funds actually invested. Then plan for two years of conditional residence and a Form I-829 filed generally in the ninety days before the second anniversary, during which the capital must stay invested and at risk.

The clock does not start when the plan does

There are three separate timetables and they are easy to conflate. The first belongs to the sale, and it is the one Solange controls least, since instalments arrive when the buyer pays them. The second belongs to the petition and any visa queue, which is published rather than negotiated.

The third begins only on admission or adjustment: two conditional years, then the removal-of-conditions filing supported by evidence that the jobs exist and the capital remained at risk throughout. A delay in the first timetable pushes everything, and pushing past 1 January 2027 introduces the adjusted amounts. A delay in the third is the more dangerous one, because a project that has not created the required positions by the time the window opens leaves her with capital still exposed and a petition she cannot yet support.

Neither timetable rewards optimism, and both reward starting the source-of-funds work early.
