Charlottetown L-1 guide: plan a launch without assuming a common family timeline

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A new-office proposal needs substantive role and operating evidence even when family relocation is the main practical concern. Separate the principal’s launch requirements from the status and intended activity of each accompanying person. A new-office L-1 decision asks whether the foreign and U.S. organizations, the transferee’s prior work, and the planned operation will support the stated role after launch. The person needs one continuous qualifying year with the related foreign organization during the preceding three-year period. New-office evidence should show premises and a practical path to doing business, not merely a registration certificate. Hypothetical example: a company that refurbishes industrial microscopes wants its foreign operations manager to establish a U.S. service centre. Decide whether the proposed hires and premises leave the manager directing the operation rather than repairing every instrument personally.

01

Describe the actual role and organization

Hypothetical example: a manager is proposed for a U.S. launch while a partner seeks to retain employment and a child plans to join later. Establish the qualifying entity relationship, foreign employment and real duties first. A relocation plan does not prove managerial capacity, and registration alone does not establish doing business. Start with the corporate relationship and foreign business activity. Assemble ownership records, financial or tax materials, organizational documents, payroll, and the transferee’s past duties. The decision is whether the foreign entity is demonstrably operating and the connection to the U.S. entity is documented, before an organization chart is asked to do too much work.

02

Apply the correct launch requirements

L-1A review includes sufficient premises, required foreign managerial or executive employment and ability to support the intended managerial or executive role within one year of approval. L-1B requires specialized-knowledge assessment, premises and financial ability to pay the employee and begin doing business. The family’s preferred route does not replace either substantive standard. Then test the future role against the launch plan. For L-1A, identify authority, staffing, budgets, reporting, and the work performed by others. For L-1B, identify the specialized knowledge, premises, financial ability to pay, and a start to doing business. The initial new-office approval is limited to at most one year, so the reader must decide what evidence will exist for extension.

03

Keep launch and family dates individually supported

The new-office framework concerns a U.S. organization doing business for less than one year, with initial approval limited to at most one year. An extension needs its own evidence. Review the actual relationship and status of each accompanying person rather than assuming every partner qualifies or later arrivals receive a longer stay. Business and school dates are planning constraints, not immigration decisions. L-1 also requires one continuous qualifying year abroad within the prior three years and a parent, branch, subsidiary or affiliate relationship with both entities active. L-1A and L-1B status are capped at seven and five years respectively. Keep family and business calendars separate. An L-2 spouse may work when valid classification and suitable evidence establish permission, while children may study but do not gain work authorization just through dependant status. A delayed lease, licensing date, or school term should lead to an updated factual plan. It should never be used to recreate foreign employment dates or overstate the company’s readiness.
