IN THIS GUIDE · Keep qualifying immigrant capital, job creation, and residence stages in their proper order
Start with the EB-5 eligibility and application overview
Identify the qualifying capital allocation
Separate the investment from administrative charges, professional fees, taxes, household reserves, and contingencies. The applicable minimum depends on the investment facts and current rules. A spreadsheet should make clear which amount is actually being contributed to the new commercial enterprise. Label every amount by legal purpose and recipient. The contribution record should be distinguishable from administration, tax, financing, and household payments.
Document the lawful source and path
Records should explain how funds were earned, gifted, sold, borrowed, accumulated, and transmitted. Each transfer needs a credible connection to the prior one. An asset valuation or a vague family statement does not by itself establish that the capital was lawfully obtained and available for the investment. Start the source record with the event that generated the money, then follow each account movement. A clear chain is more useful than a closing balance alone.
Connect the project to qualifying jobs
The job model depends on the chosen investment structure. State the expected employees, business activity, timetable, and economic assumptions without presenting projections as completed employment. A business that will use indirect-job methodology must satisfy the rules applicable to that structure. Identify the job methodology and the records that will later support it. Do not call a projected position created before the applicable evidence exists.
Plan for conditional residence
After the applicable immigrant process, permanent residence is conditional for the initial period. The later I-829 stage examines whether the required capital was invested or actively being invested and whether the job-creation requirements were met or are being met under the applicable standards. Preserve records from the beginning. Preserve business and contribution records throughout conditional residence. Later review depends on evidence that cannot reliably be recreated from memory.
Treat family dates and visa availability separately
Derivative family analysis involves relationships, age, visa availability, and process timing. It is not solved by a larger transfer amount. A child nearing a key age needs careful individualized review, including any Child Status Protection Act question and the actual filing and availability dates. Put visa-availability and age questions on a separate calendar. A commercial closing date does not decide either family issue.
