L-1B is for a qualifying organization transferring an employee with specialized knowledge. As with other L cases, the person generally needs one continuous qualifying year abroad in the relevant three-year period and the related entities must meet the required relationship. The evidence must explain why the employee's knowledge of the company's products, services, research, equipment, techniques, management, or procedures is special in context. L-1B classification has a five-year maximum period of stay. A usable explanation answers three related questions: what the company knowledge is, how this employee obtained and applied it, and why the U.S. assignment needs that particular contribution. General claims of talent, loyalty, or access to confidential material usually leave those questions unanswered. Project history, training, product context, and a detailed proposed role can connect the evidence without exposing more proprietary information than necessary. The planned role must use the claimed knowledge rather than merely mentioning it in a support letter. Build the timeline around actual employment and project records, including who trained the employee, which systems they used, and the planned U.S. deliverables. A receiving company should be able to explain why ordinary recruitment or generalized onboarding would not meet the immediate operational need. A useful first review isolates the claimed knowledge from ordinary industry competence and identifies the records that prove its acquisition. It should also calculate the qualifying foreign-service period and any time approaching the five-year ceiling. Hypothetical example: a paper-manufacturing technician trained on a foreign affiliate's machine-calibration method is assigned to troubleshoot a U.S. installation. The decision is whether training records and project evidence show uncommon company knowledge, rather than a description of general mechanical skill.

IN THIS GUIDE · Demonstrate specialized knowledge held by the transferee, not merely company familiarity

Start with the L-1B eligibility and application overview

01

Trace the company connection

Document how the foreign and U.S. organizations are related and who controls them. A vague statement that businesses are part of the same group is weaker than ownership records, formation documents, and a clear corporate chart. The relationship must exist in fact, not merely in a future plan. Identify any intermediate entity and its voting or ownership role clearly for assessment. Identify each entity's controlling owners and any intermediate company in the chain. A single missing link can change the relationship analysis.

02

Show the qualifying overseas employment

Give dates, payroll evidence, duties, and a supervisor's account of the work performed abroad. The relevant year is not satisfied by collecting disconnected short engagements. Explain the person's progression into the knowledge that the U.S. assignment needs. Compare payroll dates with travel, leave, and job-change records. Explain a gap with contemporaneous material, not a later conclusion.

03

Define specialized knowledge concretely

Avoid claims that every experienced employee has unique knowledge. Describe the proprietary process, product configuration, customer implementation method, or operational system; then identify the training, use, and level of access that distinguish this employee from ordinary practitioners. Name the system, technique, or configuration at issue and show how the applicant used it. Internal access alone does not establish the required distinction.

04

Link knowledge to the U.S. assignment

The future role should require the claimed knowledge. A position description that mostly lists generic duties can undermine the connection. Include why the receiving operation needs the transferee now and how the specialized contribution fits within its staffing and service model. Match each planned deliverable to the knowledge described in the evidence. If a local employee could perform most duties after ordinary orientation, explain the remaining need carefully.

05

Watch the five-year limit and dependents

Time in L-1B is subject to its five-year ceiling, with any recapture or category-change questions requiring fact-specific review. Household travel plans do not alter that limit. A qualifying L spouse's permission to work differs from a child's status, so record each person's intended activity independently. Calculate remaining L-1B time before promising a project end date. Dependent plans should be reviewed independently of the technical assignment.
