L-1A serves a qualifying organization transferring a manager or executive to a related U.S. operation. The applicant generally needs twelve uninterrupted months of qualifying overseas service during the relevant three-year lookback, followed by a proposed executive or managerial assignment. The employer relationship, the prior role, and the future role all need evidence. An L-1A stay is limited by the applicable seven-year maximum, and a new operation has additional first-year evidence requirements. Start by separating the company chart from the person's job history. Ownership documents must explain why the organizations are eligible affiliates, while payroll and role evidence show what the transferee actually did abroad. The proposed U.S. organization chart then needs to show how the person will direct work at the required level. A small enterprise can require careful explanation of staffing and function allocation; calling an individual an executive does not answer who performs ordinary sales, administration, or delivery work. When the operation is new, describe premises, funding, projected hiring, customers, and the first-year timeline in one realistic account. The evidence should show a business developing toward a supportable managerial structure, not an applicant performing every essential task under a senior title. The initial review should yield a corporate-relationship diagram, an overseas employment timeline, and a future staffing map. Confirm the foreign-service dates against the applicable three-year lookback and calculate time already counted toward the seven-year ceiling. Hypothetical example: a publishing company wants its overseas operations head to launch a U.S. subsidiary. The key decision is whether the first-year staffing plan will leave that person directing an organization rather than personally handling every order and invoice.

IN THIS GUIDE · Connect the proposed executive or managerial role to a real qualifying transfer

Start with the L-1A eligibility and application overview

01

Map the qualifying organizations

Show the parent, branch, subsidiary, affiliate, or other qualifying connection using governing documents and ownership records. A commercial partnership or shared customer base is not automatically the required relationship. The entity chart should agree with the records that establish control. Reconcile share registers, voting rights, and formation records before relying on a simplified group chart. The same ownership explanation should work for both organizations.

02

Establish the foreign role and period

Payroll, employment letters, organizational materials, and contemporaneous business records should identify what the transferee did outside the country. The relevant foreign employment must be continuous for one year during the statutory lookback. Titles do not replace evidence of the role's actual responsibilities. Mark any leave, payroll gap, or change of employer on the timeline. The review should identify the record that proves uninterrupted qualifying service.

03

Describe executive or managerial capacity

Explain authority, discretion, staff structure, budget responsibility, and the level at which the person directs work. A manager of a function may qualify on its own facts, while a supervisor who mainly performs routine production work may raise a different issue. Scale and staffing must be described candidly and realistically. Separate policy-setting, budget authority, and personnel direction from routine production tasks. A duty calendar can reveal where the proposed role actually sits.

04

Address a newly established operation

A new office requires evidence of secured premises, the qualifying relationship, capitalization, and a plan showing the U.S. business can support an executive or managerial position within the initial period. Opening a bank account or registering an entity alone is not the complete showing. Tie projected hires to dates, funds, and a practical workload. A chart without payroll or a recruitment plan may not show how routine work will be absorbed.

05

Keep duration and family matters visible

The category's seven-year ceiling is not extended by a business preference. L dependents have their own status records and dates. A qualifying spouse may be authorized to work by virtue of valid status, with appropriate evidence; children can study but do not gain general work permission merely from derivative status. Track the principal's remaining L time beside every dependent's document expiration. A family calendar does not extend the principal classification.
