IN THIS GUIDE · Examine the actual professional engagement before relying on its label
Start with the TN eligibility and application overview
Identify the hiring arrangement
Name the employer, reporting line, worksite, duties, compensation, and duration. The petition or admission request should reflect a real professional position. A consultant relationship can be possible, but its facts must show qualifying employment rather than an invented job description around an independent business plan. Confirm who can hire, pay, direct, and end the engagement. A contract should not assign those functions to the applicant while the letter attributes them to someone else.
Read the USMCA occupation entry
Start with the listed profession and then read its education, degree, licence, or experience alternatives carefully. A title such as analyst, manager, or adviser does not control. The question is whether the proposed tasks and individual preparation fit the relevant occupation entry. Make a duty matrix with actual tasks in one column and qualifications in another. Resolve a mismatch before choosing a title.
Treat citizenship and credentials as separate proofs
Canadian citizenship differs from Canadian permanent residence. Diplomas, transcripts, credential evaluations where needed, and licensing material should connect to the applicant personally. A professional licence can be required by the place of practice even when the degree itself supports the USMCA qualification. Record the issuing institution, degree field, completion date, and any jurisdiction-specific licensing barrier that affects the stated work.
Keep ownership from changing the facts
TN is not permission for self-employment. An applicant should disclose any interest in the receiving enterprise and consider whether control makes the claimed employment unreal. Minority foreign ownership can require careful explanation; it should never be hidden or used to recast owner-operated work as ordinary employment. Review voting rights, signature authority, and the ability to replace the employer. Those facts can settle whether the employment description is genuine.
Plan only from authorized activity
A job start date, a lease, or a client expectation is not proof that the proposed activity is permitted. Review dependent needs separately because TD status does not provide employment permission. The temporary nature of the engagement and each renewal or filing decision deserve their own current assessment. Record the authorized role and start condition separately from commercial plans. If the position changes, repeat the occupation and employment analysis.
