THE SHORT ANSWER

A new-office L request should make a practical, evidence-based case for how the related U.S. organization will develop during the initial period. The corporate relationship must be clear, the transferee must have qualifying foreign employment, and the proposed role must be executive, managerial, or specialized-knowledge as applicable. For an L-1A executive or manager, the first-year plan should show how the business will grow into an operation that supports that capacity rather than depending on the transferee for every routine task. Hypothetical example: a foreign company leases a small U.S. space, appoints its operations director, and plans local hires. Lease evidence, capitalization, a staffing plan, services, contracts, and a realistic organization chart are more useful than broad statements about expansion. Treat the business plan as an operational forecast that can be checked against real records. It should name the proposed services or products, explain the market, list startup obligations, and show when staffing is expected to take on routine work. A projection without premises, funds, or a credible work model is weak. Hypothetical example: a foreign retailer plans a U.S. distribution arm. The first-year materials should identify inventory flow, customer acquisition, warehouse needs, hires, and the role of the transferee in directing rather than personally completing every shipment. If plans change after filing, assess the change honestly. A new operation can evolve, but documentation should not claim a mature manager structure before the business can support it. Keep the factual record current as negotiations, official instructions, or family circumstances change; an earlier assumption should be corrected carefully before it becomes a submission. Hypothetical example: a foreign laboratory-equipment manufacturer leases a testing suite and proposes to transfer its production director. The concrete decision is whether premises, capital, client development, and a hiring schedule show a first-year organization that can support the claimed capacity, rather than only a registered entity and a title. The employment record must independently establish the required qualifying foreign service.

01

Establish the corporate and foreign base

Provide formation, ownership, and control records for the entities plus foreign payroll and job evidence for the transferee. The U.S. entity's formation date does not eliminate the need to prove the established foreign organization and the qualifying relationship. Compare ownership records with the foreign payroll and job evidence. Each should identify the same established organization and proposed transferee.

02

Document the launch

Show secured physical premises, available capital, contracts or market groundwork, operating costs, and an implementation schedule. A virtual address or an unopened bank account may be a preliminary step, not a complete new-office showing. Use signed premises and funding records to distinguish preparations already completed from future intentions. Mark contingencies plainly.

03

Explain the first-year organization

Set out who will perform sales, delivery, administration, and supervision as the company grows. For L-1A, connect the plan to a role that will direct managers, professionals, or an essential function rather than mainly perform the business's basic output. Assign routine functions to planned staff or vendors and place them on a dated schedule. That shows what the transferee will direct after launch.
