A Charlottetown manager considering L-1A should establish the qualifying transfer while giving the household’s employment needs their own review. The company relationship, foreign employment and actual U.S. managerial or executive duties remain essential. A shared relocation goal does not establish dependent eligibility or permission. An L-1A strategy is strongest when the business record shows an operating corporate relationship and a role that is genuinely executive or managerial. The transferee needs one continuous qualifying year with the linked foreign organization during the previous three years. The maximum L-1A period is generally seven years, so the role and longer business plan should be assessed together rather than treating the category as open-ended.

IN THIS GUIDE · Assess the transfer and the partner’s employment plan separately

01

Show the actual managerial role

Hypothetical example: the employer proposes a management transfer while the applicant’s partner plans to continue working. First identify the applicant’s authority, duties and operational support. A management title or household preference cannot substitute for evidence of the qualifying role. Start with the organizations. Establish ownership or control, document that the foreign business is doing business, and identify which entity will employ the transferee in the United States. A new office needs separate attention to premises, funding, a practical staffing model, and the position expected after the initial period. Incorporation alone does not establish an operating business relationship.

02

Document the transfer foundation

Provide qualifying ownership or control, relevant foreign employment dates and physical locations, and actual business activity. Assess the required foreign employment within the applicable lookback period individually. U.S. time does not count toward the required foreign year. Then examine the job at the level of authority. Identify subordinate managers or professionals, decision rights, budget responsibility, reporting lines, and the tasks that others will perform. A senior title loses force when records show the transferee will mainly produce the company’s core service. The decision is whether the evidence supports management of an essential function or organization rather than routine execution.

03

Review the operating stage

If the U.S. organization has been doing business for less than one year, assess L-1A new-office requirements: sufficient premises, required foreign managerial or executive employment and ability to support the intended managerial or executive role within one year of approval. Initial new-office approval is limited to at most one year. Finally, plan family and timing consequences from actual evidence. A qualifying L-2 spouse may work when valid classification and appropriate proof establish that permission; children can study but are not independently work-authorized through L-2. Keep the corporate launch date, foreign employment dates, and household arrival dates on separate calendars. A delayed lease or hire should lead to an updated plan, not an inaccurate historical narrative.

04

Identify the partner’s actual eligibility and activity

Record the relationship and intended work rather than assuming the word partner establishes qualifying dependent status. Qualifying L spouses may be employment-authorized incident to status with appropriate documentation. The principal’s offer alone does not establish the accompanying person’s current permission. For an established operation, explain how the staffing model leaves the transferee free to manage rather than perform the ordinary service. For a function manager, identify the essential function, its strategic importance, and the authority exercised over it. The first review should state which records—payroll, contracts, budgets, or reporting documents—best test the claim.

05

Establish the qualifying foreign year and active organizations

The foreign employment generally must include one continuous qualifying year within the relevant preceding three-year period, assessed on the individual facts. U.S. days do not count toward that foreign year; a trip should not automatically be treated as breaking continuity. The qualifying organization must do business in the United States and at least one other country during the relevant period, through regular, systematic and continuous provision of goods or services rather than registration alone. The entities must have a qualifying parent, branch, subsidiary or affiliate relationship and remain actively doing business. L-1A status is capped at seven years. Extensions require a current operational picture, not merely the original launch forecast. Preserve records of employees, revenue-generating activity, premises, reporting lines, and the transferee’s actual decisions. A business can change course, but the filing should acknowledge the change and explain why the resulting role still fits the classification. Avoid treating a growing workload as evidence of executive duties by itself.
