FOR PROFESSIONALS · CORNWALLCornwall

Your talent.A bigger stage.

A Charlottetown applicant considering TN should assess the actual professional employment independently from a business ownership proposal. Eligible Canadian or Mexican citizenship, work in a listed profession and the required qualifications must align. An ownership opportunity does not automatically provide a different way to perform the same U.S. work. A useful TN discussion begins with the actual professional arrangement, not the household’s preferred move date. Confirm the applicant’s citizenship, the Appendix 2 occupation, who directs the work, and the qualification rule that fits the duties. Canadian nationals commonly seek classification at an inspection location, while an employer may use Form I-129 through USCIS in an appropriate case. This route is for prearranged professional employment; it does not authorize self-employment through an applicant-controlled U.S. enterprise. Hypothetical example: a Charlottetown aquaculture veterinarian receives an employer letter that omits field-inspection duties. The applicant must decide whether the complete assignment fits the listed veterinarian profession and its licensing rule before choosing an inspection request or employer-filed petition.

IN THIS GUIDE · Compare the professional offer with the ownership opportunity

01

Define what each option actually involves

Hypothetical example: one proposal is employment in a professional role, while another involves buying a business and delivering its services. Identify employer, duties, ownership and control separately. Do not use the employment offer’s description to support an unrelated owner-operated arrangement. First, turn the offer into a factual checklist. Compare the task list, worksite, supervisor, compensation, anticipated term, and professional credential with the precise occupation claimed. A broad job title or a commercial plan to find future clients cannot replace this comparison. The decision is whether the written employment proposal describes the same role the person will actually perform.

02

Apply the precise TN requirements

Identify the listed profession and its actual credential rules, including permitted alternatives. Canadian permanent residence does not satisfy eligible TN citizenship. Business experience or available capital does not universally replace qualifications or establish that the offered duties fit the profession. Second, prepare evidence by purpose rather than by volume. Citizenship proof, degree records, required licence material, a focused résumé, and the employer letter should answer different questions without contradiction. If a credential is foreign or the work is regulated, resolve that point before relying on travel timing. A concise index helps reveal a missing link.

03

Review ownership facts without shortcuts

Disclose relevant interests and relationships for assessment. Foreign ownership alone is not a blanket disqualification, while TN does not provide general authorization for U.S. self-employment. The real employment arrangement matters more than the label assigned to the opportunity. Third, keep ownership and family issues outside the professional test until they are separately assessed. An applicant may have an ownership interest without automatic disqualification, but control over the receiving business can create a self-employment problem. TD family members may accompany or follow, yet TD does not confer employment authorization. A workable household plan therefore records each person’s permitted activity independently.

04

Include the household’s work needs

Identify the spouse’s intended activity separately rather than assuming a favourable offer solves it. TD does not authorize employment. Compare household consequences alongside the principal’s role, then use the actual selected facts for the appropriate process before starting U.S. work. TD dependants may study but may not work. A Canadian citizen may request TN classification at a port of entry, or a U.S. employer may file Form I-129; a Canadian generally does not need a TN visa stamp. Choose the presentation channel after the professional record is complete. A direct Canadian inspection request and an employer-filed USCIS petition have different practical sequences, but neither changes the need for a genuine employer-directed role. Retain the final letter and supporting records used for the actual route, so later extensions or travel do not depend on an outdated description.

05

Apply the temporary-work and credential boundaries

TN concerns qualifying temporary professional activity for Canadian or Mexican citizens. Providing services to a U.S. entity solely owned or controlled by the applicant falls outside the permitted arrangement; a foreign business interest alone is not a blanket disqualification. Degrees from institutions outside Canada, Mexico and the United States require a reliable foreign-credential evaluation. Any licence needed to practise the profession in the United States is a separate question from the listed TN qualification. Treat changes as material when they alter employer, profession, duties, ownership, work location, or the facts supporting qualification. A start-date adjustment may be manageable, while a move from employment into an applicant-controlled service company calls for fresh analysis. The decision should be based on the arrangement that will exist, not an earlier version that was easier to describe.
