FOR SPECIALIST TEAMS · CORNWALLCornwall

Your expertise.Across borders.

A Charlottetown L-1B proposal should establish the applicant’s qualifying specialized knowledge and actual U.S. assignment while keeping family arrival plans separate. Related-company employment and technical experience alone do not establish every requirement. Each accompanying person needs the appropriate status for their own activity. L-1B is not a general solution for a valued employee. It needs a qualifying corporate relationship, one uninterrupted foreign year during the prior three years, and a U.S. role based on specialized knowledge. The total L-1B stay is generally limited to five years. Start by describing the knowledge, its acquisition, and why the U.S. entity needs this particular employee now.

IN THIS GUIDE · Coordinate a specialist transfer with later family arrivals

01

Explain the specific knowledge and assignment

Hypothetical example: an employee will transfer internal expertise first, with family members arriving later. Describe the actual process or product knowledge, how the applicant acquired it and what they will do in the United States. Do not let the relocation sequence replace the substantive role explanation. The knowledge record should be concrete without exposing unnecessary trade secrets. Explain internal systems, advanced processes, proprietary methods, training pathways, and the applicant’s prior work with them. Compare that evidence against the role of colleagues and the receiving organization’s need. A bare assertion that replacement would be inconvenient does not settle the specialized-knowledge question.

02

Use the actual specialized-knowledge standard

Assess special knowledge of the organization’s products, services or related interests and international application, or advanced knowledge of its processes and procedures. It need not universally be unique or secret. A senior title or general industry experience is not a complete individual showing. Corporate and employment documents should form one chronology. Link the related entities, foreign payroll, project history, training materials, and planned duties without changing names or dates between records. If the applicant will advise a new office, distinguish the business’s early-stage needs from a claim that every technical task requires unique knowledge. The decision is whether the explanation matches real operations.

03

Document organizations, history and placement

Provide the qualifying company relationship, required foreign employment and genuine knowledge records. Explain actual supervision and any customer placement. For placement at an unaffiliated worksite, show that the petitioning employer controls and supervises the employee and that the arrangement is not labour-for-hire; the placement must instead relate to a qualifying product or service requiring specialized knowledge. Household planning remains separate from the technical case. A qualifying spouse in L-2 classification may work when valid status and suitable evidence establish permission, while children may study but do not gain work permission simply as dependants. Keep work starts, licensing, and school dates flexible. None of those plans can supply the missing corporate or knowledge evidence for L-1B.

04

Keep family dates individual

Record relationship, citizenship and intended work or study for each later arrival. A qualifying L-2 spouse is employment-authorized incident to status with appropriate documentation, while children do not receive work authorization solely through L-2 status. Do not assume everyone automatically receives identical dates or permission. Review the actual individual process and documents; a school or travel preference does not decide the immigration outcome. Specialized knowledge should be connected to a real U.S. business need. Describe the receiving team, the project phase, the internal tools involved, and why the transfer is not simply an attempt to fill an ordinary vacancy. The most persuasive record lets a reviewer understand the knowledge’s practical value without requiring disclosure of every confidential technical detail.

05

Complete the foreign-employment and new-office assessment

L-1B generally requires one continuous qualifying year of foreign employment within the relevant preceding three-year period, along with qualifying organizations that meet the doing-business requirements. Assess actual dates and locations; U.S. days do not count toward the foreign year. For a U.S. organization doing business for less than one year, the L-1B new-office evidence includes sufficient premises and financial ability to pay the employee and begin doing business. Initial new-office approval is limited to at most one year. The entities must have a qualifying parent, branch, subsidiary or affiliate relationship and remain actively doing business. L-1B status is capped at five years. Keep a renewal file while the assignment proceeds. Save updated duty descriptions, project reports, training records, payroll, and evidence of the corporate relationship. If the employee begins mainly performing routine work or the business adopts a different system, reassess the classification rather than relying on the original filing narrative. The cap on total L-1B time makes this review especially important.
