Cornwall: the client deployment is before my qualifying year abroad matures — can we still file?

THE DIRECT ANSWER

Use completed evidence and current process stages instead of treating a desired launch or travel date as a government outcome.

L1B planning question: timing

Avoid treating a product deadline as proof that a transfer can happen immediately. First verify the foreign employment dates, prepare the organization evidence, identify the specialized knowledge, and match it to the U.S. assignment.

Hypothetical example: a client deployment is scheduled before the applicant's one-year qualifying overseas period has matured. Reassigning the label to urgent support does not solve that temporal requirement. The company can document the business need while recognizing that the classification process has its own stages.

Track the maximum L-1B period from prior relevant time, review any change in role carefully, and plan dependent travel only after considering their documents and the principal's actual status. Maintain a dated log of documents obtained, contracts signed, funds transferred, petitions filed, interviews or inspections completed, and actual admission records. This is more reliable than a single calendar marked with hoped-for outcomes.

Identify which event is within the applicant's control and which rests with an agency, employer, seller, or third party. If the schedule moves, update every dependent commercial and family commitment. Do not backdate letters, payments, job starts, or role changes to preserve a preferred narrative.

A candid later date is usually easier to explain than a record that conflicts with bank statements, payroll, lease documents, or travel history. Build flexibility into commitments whenever the outcome is not yet confirmed.
