Cornwall: how far back does an EB-5 source-of-funds record have to reach?

THE DIRECT ANSWER

Collect records that prove the real transaction, role, relationship, and timeline rather than polished summaries alone.

EB5 planning question: documents

Create a source-of-funds chronology that begins before the investment account. Include tax records, business ownership material, sale agreements, bank statements, loan papers, gift documentation if relevant, currency transfers, and final investment receipts. The goal is to show how each material amount was earned or obtained lawfully and how it reached the enterprise.

Hypothetical example: funds come from dividends, a property sale, and a documented loan. Keep each route separate before showing how they combine. Do not rely on a net-worth letter as a substitute for transaction evidence.

Preserve the offering, subscription, escrow, enterprise, and job-creation records too, because later conditional-residence review looks beyond the original transfer. Create an index that gives each record a date, issuer, purpose, and relationship to the next record. Where a document is translated, preserve the original and the translation in the required form.

Reconcile names, account numbers, addresses, entity names, and dates before submitting anything. An unexplained inconsistency can distract from otherwise strong evidence. Avoid altering historical records to make a file neater; a transparent explanation is safer than a manufactured appearance of continuity.

Keep copies of final versions and receipts so later questions can be answered from the same factual record. Current official forms and filing instructions should be checked close to the relevant process because a well-organized older package can still use obsolete requirements.
